The Board of Certified Safety Professionals (“BCSP”, “we”, “us”, and “our”) offers globally accredited credentials and expert resources to support individual career development, the enhancement of organizational safety cultures, and the advancement of safety practice in general. We offer these services through BCSP’s interactive online websites, applications, and services.

This Privacy Policy (the “Policy”), explains what Personal Information (defined below) we may collect from or about you when you access our website, https://www.bcsp.org, or any other website we control on which we have posted this Policy (collectively “Website”) and any of the mobile or other applications we control that reference this Policy (“Applications”) (together with the Website, our “Services”) This Policy also governs how we and others may use Personal Information, under what circumstances we may disclose Personal Information to third parties, and the instances in which we may allow third parties to collect Personal Information from you directly.

Depending on your activities when using or accessing our Services, you may from time to time be required to agree to additional terms and conditions.

This Policy applies to information we collect:

Through our Services.
In email and other electronic messages between you and BCSP via our Services.
Via your interaction with our advertisements on third-party websites and services, if those advertisements include links to this Policy.

This Policy does not apply to information collected by:

Us offline or in person.
Us through any website, content, application, or service we may offer which does not link to this Policy.
Any third party, including through any application or content (including advertising) that may link to or be accessible from or through our Services.

Our Services are hosted in the United States. If you reside outside of the United States, please be aware that if you use our Services your Personal Information will be processed inside the United States and will be subject to the laws of the United States and this Policy.

Modifications to this Policy

We maintain this Policy on our Website and in our Applications. You should review this Policy frequently, as it may change from time to time and without notice. Any changes will be effective immediately upon the posting of the revised Policy and will apply to all information collected after we post the revised Policy. B. Information We May Collect

We may collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual (“Personal Information” or “Personal Data”). Personal Information does not include information that is anonymized or de-identified consistent with applicable law. As applied to United States residents, Personal Information also does not include publicly available information as defined by applicable law.

We reserve the right to use information which does not qualify as Personal Information for any purpose which is valid under applicable law. Please note that if we combine or connect non-personal data with Personal Information so that it directly or indirectly identifies an individual, we treat the combined information as Personal Information under this Policy.

It is your choice to provide us with your Personal Information. Failure to provide required Personal Information necessary to provide our Services may result in our inability to provide you with our Services. If you have questions about what information may be required to receive our Services, please contact us as provided below.

We collect the following information, including within the last 12 months:

Identifiers. Such as first name, last name, address, email address, account name, IP address, or other similar identifiers.

Other Personal Information. Such as name, signature, profile photograph, address, telephone number, membership in professional organization (ours), professional licenses and certifications, financial information (for payment purposes). BCSP uses a payment service provider and only stores the type of card you use and the last four digits of the card number. Note: Some information in this category may overlap with other categories.

Protected Classification Characteristics. Such as race and ethnicity/ethnic origin (voluntary).

Commercial Information. Such as details of products and services you have considered, ordered, or purchased from us.

Internet or Other Similar Network Activity Information. Such as internet protocol (IP) address, language preference, browser type and version, time zone setting and location (including as provided by certain third-party service providers to better help the visually impaired), browser plug-in types and versions, referring/exit pages, number of clicks, ads viewed, Equipment information such as device type, operating system and platform, and other technology on the Equipment you use to access our Services. Activity on our Website and Application, such as internet browsing history, system usage, electronic communications with us, and posting on our social media sites.

Professional or Employment-Related Information: Such as information about your profession or business, job function, company size, position name, and information related to professional or educational certificates.

Geolocation Information. Such as imprecise location information such as your city and state of residence or your zip code.

Account Information. Such as your account login information such as username and password, your interests, preferences, feedback and survey responses.

Marketing and Communications Information. Such as your preferences in receiving marketing from us and third parties, your communication preferences, and comments and feedback you provide through our Services.

Sensitive Personal Information. Racial or ethnic origin (optional and with your consent if required and permitted). We do not use this information to make inferences about you.

C. How We Collect Information

We collect information from or about you in the following ways:

Directly from you. For example, when you complete forms (such as the Contact form available on our Website); purchase, access, or use our products and services; provide feedback, complete surveys, or request customer service; apply for and/or receive a credential; post comments, photos, videos, or other information to our social media pages or when you review us; or when you otherwise communicate with us.

Automatically from your Equipment. With your consent if required, when you access or use our Services, information associated with you and/or the Equipment you use to access the Services may automatically be collected or received through device-based tracking technologies such as cookies, pixels, tags, beacons, or other technology. We may also automatically collect or receive such information any time you interact with our advertising and content on other websites and platforms. Advertisers and other third parties also may collect information from your interaction with advertising on our Services.

From third parties. We may receive information about you from vendors and service providers we hire to help us run our business, including the companies that host or operate our website and applications, process payments for us, send emails for us, and provide marketing, analytics, and advertising services. Additionally, other users of our Services may provide us with your information so that we may invite you to use our Services.

With your consent if required, we may automatically receive and store certain types of information whenever you interact with our Services. We may use cookies to provide additional features or functionality to your experience when you use our Services, for example storing your preferences and other information about you when you use the Services. You may block or limit the storage of cookies via browser controls or other software. You may also delete cookies manually from your device through your internet browser, operating system, or other programs. Please note that some portions of our Services may not function properly or be available if you block or delete certain cookies.

Web beacons. are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, and to provide other information.

Use and Disclosure of Personal Information

With your consent if required, we may use or disclose the Personal Information we collect as follows:

Develop, offer, and provide you with our products and services, such as administering and maintaining a credential or providing access to your account.
Send you products or provide you with services that you have ordered, including processing payments and providing you updates about the status of your order.
Improve our products or services, marketing, or customer relationships and experiences, including through use of data analytics.
Manage our relationship with you which may include notifying you about changes to our Services, Terms of Use, Privacy Policy, or any other policy we maintain to which this Policy links, providing you notices about your account, asking you to provide feedback or take a survey, or addressing any questions you may have about our products or services.
Deliver relevant content, advertisements, and messaging to you and to measure or understand the effectiveness of such content, advertisements, and messaging.
Respond to your requests from us, including Data Subject Access Requests, or to fulfill any other purpose for which you provide it.
To contact you about our own or third parties’ products and services that may be of interest to you.
With your consent, consistent with applicable law.
Administer our systems and conduct internal operations, including troubleshooting, data analysis, testing, research, statistical, and survey purposes.
Administer and maintain our systems and operations, including for safety purposes.
Engage in corporate transactions requiring review of the Personal Information we hold, such as for evaluating potential Company mergers and acquisitions.
For any other purpose as may be permitted by law or that we describe when you provide the information.
To comply with any court order, law, or legal process, including responding to any government or regulatory request.
To enforce our Terms of Use, Privacy Policy, or other applicable policies or agreements with you.
To protect the rights, property, or safety of our business, employees, customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.

We use location information we collect to provide the Website Services. In addition, we may use location information to target our marketing and advertisements to you, with your consent if required.

Disclosure of Your Personal Information

We may share information that does not identify you without restriction. We may disclose Personal Information, including within the last 12 months, as follows:

To our contractors, service providers, and other third parties we use to support our business, such as payment processors, security services, website hosting services, etc.
To researchers for research purposes, pursuant to a written agreement with BCSP.
With your consent, consistent with applicable law.
For any other purposes that we disclose when you provide the information.
To fulfill the purpose for which you provide it.

We may also disclose Personal Information to others:

To comply with any court order, law, or legal process, including responding to any government or regulatory request.
To enforce or apply our Terms of Use, this Policy, or other applicable policies or agreements with you.
To protect the rights, property, or safety of our business, employees, customers, or others. This includes exchanging information with other companies and organizations for the purposes of cybersecurity, fraud protection, and credit risk reduction.
To investigate suspected violations of any law, rule, or regulation, or the terms or policies for our Services.
In the event of merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all our assets, where one of the transferred assets is the Personal Information we hold, including for due diligence purposes regarding the same.

To Whom We Disclose Personal Information

We may disclose your Personal Information to the following:

Service providers. We may share Personal Information with vendors who help us with certain services, including customer support, email and text message deployment, research and analytics, marketing and advertising services, data processing, management, analytics, fraud prevention, transaction and payment processing, survey administration, and order fulfillment.

Business Partners, Advertisers, and other Third Parties. With appropriate consent where required, we may share Personal Information with or make it available to our sponsors, partners, advertising networks, advertising servers, and analytics companies or other third parties in connection with our and their marketing, promotional and other offers, as well as product information.

Law Enforcement, Regulators, Courts, and other Governmental Authorities. We share any of the categories of information we collect, pursuant to applicable law, to respond to subpoenas, court orders, legal process, and other law enforcement measures, to comply with other legal obligations, to respond to an emergency, or otherwise to protect our or the rights, property, safety, or security of other parties, visitors to or users of our Services, or the public.

Business or Asset Transfers. If we are involved in a merger, acquisition, transfer of control, bankruptcy, reorganization, or sale of assets, or diligence associated with such matters, we may share Personal Information. For example, if another entity acquires us or all or substantially all our assets or assets relating to any of our businesses, your information may be disclosed to that entity as part of the due diligence process and may be transferred to that entity as one of the transferred assets.

Publication of Your Credential Information

Part of the services we offer is to identify BCSP-credentialed safety professionals. We may publish Personal Information of credentialed individuals, including your name, city, state, and credential number on the Services and other print or digital media. For example, we may post your credential information and related Personal Information to our online Credential Holder Directory, similar lists, and other types of registration lists for BCSP programs and events. These lists will not include Sensitive Personal Information, such as credit card or bank information, Social Security Numbers, or race or ethnicity.

You may request that your information not be published on our registration lists by contacting us as provided in this Policy. Further, you may opt-out of sharing your information in the online Credential Holder Directory through your digital badge page in your BCSP account.

Please note that in accordance with accreditation standards, BCSP will share credential status with third parties either through the online Credential Holder Directory or when contacted directly. Even if you have opted out of sharing your information in the online Credential Holder Directory, if BCSP is contacted by other methods to confirm your credential, your credential status will be verified by BCSP.

If you wish to delete your credential and related personal information, please contact as us provided in this Policy. Please specify that your request includes Personal Information required to maintain your credential. Please note that once such request for deletion is processed, we can no longer verify your credential, and it may become void.

F. Interest-Based Advertising

Some content or applications within our Services, including advertisements, may be served by third parties, including advertisers, ad networks, servers, content partners, or application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Services. If they collect information, it may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. Such information may be used to provide you with interest-based (behavioral) advertising or other targeted content. Additionally, our partners may use non-cookie technologies on which browser settings that block cookies might have no effect. Your browser may not permit you to block such technologies.

Finally, please note that certain browsers may offer the option of providing notice to websites that you do not wish for your online activities to be tracked for interest-based advertising purposes (Global Privacy Control Notice or universal opt-out mechanisms). We will respond to and abide by the signals sent through universal opt out mechanisms consistent with applicable law.

G. Your Rights and Choices

We have created mechanisms to provide you with the following control over your information:

Marketing Information: If you do not want us to use your email address or other contact information to promote or recommend our own products and services, or third parties’ products or services, you may opt-out by replying to any promotional email we have sent you or following the opt-out links on that message. This opt-out generally will not apply to information provided to us related to a purchase, product service experience, credential, or other service-based transaction.

Accessing, Updating, and Deleting Your Information: You may contact us as set forth in the Contact Us section below to request access to, correction of, or deletion of Personal Information from or about you in our possession or control, consistent with your rights as described below. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or negatively affect the information’s accuracy.

Location Information: As noted above, when you use our Services, we may automatically collect certain information about the Equipment you are using including geolocation information. You may be able to turn off location features on your Equipment.

Cookies and Automatic Data Collection Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. However, if you disable or refuse cookies, please note that some parts of our Services may become inaccessible or not function properly. In some cases, you may be able to set your browser or email program to not download web beacons. If you have consented to the use of non-essential cookies, you may opt-out.

Interest-Based Advertising. Please see Interest-Based Advertising above for information on how to opt-out of interest-based advertising.

U.S. Residents’ Data Subject Access Rights.

Depending on in which U.S. state you are resident, you may have the following rights related to your Personal Information. For information about data subject rights under the GDPR, please see Section J below. U.S. state rights may include:

The right to know what Personal Information we process about you.
The right to request certain Personal Information that we process about you be deleted. (Please see deletion exceptions below.)
The right to request we correct Personal Information we have about you which you believe is incorrect.
The right to have certain Personal Information we process about you returned to you in an accessible and useable format upon your request, if such request is technically feasible.
The right to opt-out of having your Personal Information processed in such a way that enables us to create a profile of inferences about you or for targeted advertising purposes.
The right to opt-out of the sale of your Personal Information.

The right to opt-out of any profiling in furtherance of decisions that produce legal or similarly significant effects.
The right to limit the use of your sensitive personal information.
The right to exercise your data subject rights free from discriminatory treatment for exercising your rights.

California Residents. If you are a California resident, you may have additional personal rights and choices with regard to your personal data. For example, California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of a covered website that are California residents to request certain information regarding disclosure of their personal data to third parties for their direct marketing purposes. It is our policy not to disclose the Personal Information of individuals who have opted out of sharing their information with third parties for the third parties’ direct marketing purposes. You may exercise this cost-free opt-out mechanism by contacting us as provided in this Policy.

Nevada Residents. Nevada provides its residents with a limited right to opt out of certain Personal Information sales. Residents who wish to exercise their sale opt-out rights may submit a request using the “contact us” information below. However, please know we do not currently sell data triggering that statute’s opt-out requirements.

Exceptions to Requests to Delete

Credentials: Please note that part of the services we offer is to provide and maintain safety credentials. If you request that we delete Personal Information we maintain about you, unless you specify otherwise, we will continue to maintain the Personal Information necessary to maintain your credential. If you request that we delete all Personal Information we maintain about you and specify that your request includes Personal Information required to maintain your credential, we will honor your request, which means that we can no longer verify your credential and it may become void.

Other exceptions: We may continue to retain and use Personal Information consistent with applicable law, including as follows. We will provide you with notice of any Personal Information we do not delete pursuant to your request to delete and will only use such Personal Information for the purposes for which we may retain it.

Complete the transaction for which the Personal Information was collected, provide a good or service requested by you, or reasonably within the context of our ongoing business relationship with you, or otherwise perform a contract between us and you. For instance, we may continue to maintain your certification and credential unless you request otherwise.
Help to ensure the security and integrity of our Services to the extent the use of your Personal Information is reasonably necessary and proportionate for those purposes.
Debug to identify and repair errors that impair existing intended functionality of our Services.
Exercise free speech, ensure the right of another individual to exercise their right of free speech, or exercise another right provided for by law.
Engage in public or peer-reviewed scientific, historical, or statistical research that conforms or adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the ability to complete such research, if you have provided informed consent.
To enable solely internal uses that are reasonably aligned with and compatible with the context in which you provided the information.
Comply with a legal obligation.

How We Verify Data Subject Rights Requests

We may require that your identity be verified prior to processing verifiable rights requests. If your request requires verification, we will verify your identity by comparing the information we have about you against the information we receive when you submit your request. If we do not have enough information to verify your identity, we may request additional information from you, consistent with applicable law. We may deny a rights request if we are unable to verify your identity.

Authorized Agents

Some U.S. states permit their residents to designate an authorized agent to submit requests to exercise certain privacy rights on the individual’s behalf. Even if you use an authorized agent to submit a request on your behalf, pursuant to applicable law, we may still require that you verify your identity depending on the nature of the request and sensitivity of the information at issue.

If you are an authorized agent submitting a request on behalf of an individual, please submit a request using the contact information provided in the Contact Us section below. You must include a copy of the written, signed permission indicating that you are permitted to act on that person’s behalf.

Appealing a Denied Data Subject Rights Request

In some circumstances, we may deny your request to exercise one or more of the rights described above. If you disagree with our decision to deny your U.S. state data subject request or any portion of your request, you may appeal our decision within sixty (60) days of receipt of notice that your request has been denied. If you submit an appeal to a denied request more than sixty (60) days after you have been notified of our decision to deny the request, we may deny your appeal. If you submit a timely appeal, we will respond within forty-five (45) days of our receipt of your appeal.

If you wish to appeal a decision, please clearly and plainly describe your basis of disagreement with our decision by responding through the same means by which we communicated our decision or by submitting your appeal using the information provided in the Contact Us section below. We will review your appeal and either amend or uphold our decision. In either case, we will provide a written explanation of the reason for the decision. This decision will be final.

H. Data Security

The security of your Personal Information is very important to us. We use appropriate physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, use, alteration, or disclosure.

We will continue to enhance and update our physical, electronic, and administrative safeguards as necessary. However, the Internet environment is not 100% secure, and we cannot guarantee that information we collect will never be accessed in an unauthorized way.

I. International Transfers of Personal Information

We are a company located in the United States. If you are using our Services from outside the United States, know that the information collected by our Services will be stored and processed in the United States, or any other country in which BCSP, or its affiliates, subsidiaries, or agents maintain facilities, including hosting services or servers. By providing your information via our Services, you are consenting to the transfer of your information outside of your country in accordance with this Policy and applicable law. You are also consenting to the application of United States law in all matters concerning our Services.

Legal Bases for Processing Personal Data

1. Your Personal Data is primarily used to provide you with the Services you request. It may also be used to comply with legal obligations we are subject to and to enforce our Terms of Use.

2. With your prior consent, your Personal Data may also be used to send you tailored offers and updates about products and services from us by email or other electronic means of communication, such as showing you our ads on social media platforms.

3. Furthermore, your Personal Data may be used to fulfill our legitimate interests, such as to develop and improve our services, to provide you with an account to access our online services, or to detect illegal activities. We also rely on our legitimate interests to execute our marketing strategies, such as creating aggregated segments & models for business analytics, including to look for similar audiences on online platforms that may enjoy our ads, or to ensure these platforms do not show our ads to you. You may object to the activities based on our legitimate interest at any time by contacting us as indicated in the Contact Us section below, but we may continue processing if we have compelling interests, which override your objections.

4. The marketing activities described above do not include the use of cookies and similar technologies, for which we ask for your consent to use. Please see our Cookie Policy for more information.

EU, UK, and Swiss Residents' Data Subject Rights

You have the following rights regarding your Personal Data:

Right to request access to your Personal Data;
Right to request rectification (correction) of your Personal Data;
Right to request erasure of your Personal Data (right to be forgotten)
Right to request restrictions of processing your Personal Data
Right to object to our processing of your Personal Data
Right to request portability of your Personal Data;
Where our processing of your Personal Data is based on your consent, the right to withdraw your consent at anytime, without affecting the lawfulness of any processing based on consent before its withdrawal;
Right to lodge a complaint with a supervisory authority;
The Right to know the existence of automated decision-making, including profiling, and meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject, if we engage in such activities.

To exercise any of these rights, please contact us as provided in the Contact Us section below. If we reject your data subject request, we will notify you of our reason for doing so. You have the right to file a complaint with the Data Protection Authority, as applicable, (contact information available here) or the or with the UK Information Commissioner’s Office, as applicable, here, and to seek judicial remedy.

Please note there are some instances where we cannot honor these requests and may be required by law or other legitimate reasons to continue processing your Personal Data.

Exceptions to Right to Erasure (to be Forgotten

Credentials: Please note that one of the services we offer is to provide and maintain safety credentials. If you request that we erase Personal Data we maintain about you, unless you specify otherwise, we will continue to maintain the Personal Data necessary to maintain your credential. If you request that we erase all Personal Data we maintain about you and specify that your request includes Personal Data required to maintain your credential, we will honor your request, which means that we can no longer verify your credential and it may become void.

Other exceptions: We may continue to retain and use Personal Data consistent with applicable law, including as follows. We will provide you with notice of any Personal Data we do not erase pursuant to your request to exercise a right of erasure and will only use such Personal Data for the purposes for which we may retain it.

for exercising the right of freedom of expression and information;
for compliance with a legal obligation which requires processing by Union or Member State law to which we are subject; or
for the establishment, exercise, or defense of legal claims.

K. Minor’s Information

Our Services are not intended for use by individuals under the age of 18. We do not knowingly sell or share (as those terms are defined by applicable law) the Personal Information of individuals under the age of 18. If you are aware of individuals under the age of 18 using our services or submitting their Personal Information through the Services, please contact us using the information in the Contact Us section below so we may delete that information.

L. Data Retention

BCSP will retain information for as long as necessary to achieve the purposes for which we collect it, or as permitted or required by law.

M. Third-Party Links

Our Services may contain links to other sites, such as social media sites, which we do not control. We are not responsible for the privacy practices employed by any third-party website or service provider. You are responsible for any personal information you choose to share with any third-party website or service provider.

N. Material Changes

As noted, we may update this Policy from time to time. The updated version will be indicated by an updated “Revised Date,” and the updated version will be effective as soon as it is accessible. If we make material changes to this Policy, we may notify you either by prominently posting a notice of such changes or by directly sending you a notification, consistent with applicable law. We encourage you to review this privacy notice frequently to be informed of how we are protecting your Personal Information.
